The Background Check Gap

A pre-hire background check is a snapshot. It tells you what appeared in the record on the day it was run. It tells you nothing about what happens after that date. eMotive replaces the point-in-time background check model with continuous criminal monitoring. Once enrolled, each individual is monitored against active criminal records on an ongoing basis. When a relevant criminal event appears, eMotive generates an encrypted alert to the designated HR contact. No manual re-checks. No annual cycles. No coverage gaps.

Enrollment

The employee or contractor is enrolled in eMotive with proper FCRA-compliant written consent. Enrollment uses biometric identifiers, not name-and-DOB matching, which eliminates common-name false positives from the start.

Continuous Monitoring

eMotive monitors enrolled individuals against criminal record databases continuously. This is not a periodic re-check; it is ongoing surveillance of the record, not of the person. When an arrest, charge, or conviction appears, eMotive detects it.

Encrypted Alert

When a criminal event is detected, eMotive sends an encrypted alert to the designated HR administrator. The alert includes the nature of the event and the individual's identity. Alerts are delivered the same day the record appears, not weeks or months later.

Adverse Action Workflow

If the criminal event is relevant to the role, eMotive supports the FCRA-compliant adverse action process: pre-adverse action notice, copy of the report, summary of rights, and a reasonable waiting period before final action. Every step is documented and auditable.
